Terms of Service

1. Agreement and operator

These Terms of Service govern access to SoulScan websites, applications, assessments, communications and related services operated by Travel Growth AI in Gatineau, Quebec, Canada. By accessing or using SoulScan, you agree to these Terms and the Privacy Policy. If you use SoulScan for an organization, you represent that you have authority to bind that organization.

2. Eligibility and age restriction (18+)

You must be at least 18 years old and legally capable of entering a binding agreement to use SoulScan or enroll in its SMS program. SoulScan services and text messages are not intended for minors. By using the service or opting in to SMS, you confirm that you are 18 years of age or older.

3. What SoulScan provides

SoulScan provides relationship intelligence, governed recommendations and operator-supported workflows. Services may organize evidence, infer patterns, prepare content, recommend next steps and connect approved tools. Features, service levels and operator responsibilities depend on the plan, statement of work or order agreed with you.

4. Accounts and workspace responsibility

• Provide accurate account and organization information and keep it current.
• Protect credentials and promptly report suspected unauthorized access.
• Use only workspaces, records, integrations and data you are authorized to access.
• Ensure your users and representatives comply with these Terms and applicable laws.

5. Acceptable use

You may not use SoulScan to violate law or third-party rights; misrepresent identity or authority; scrape, message or monitor people unlawfully; send spam or communications without the necessary consent; upload malicious code; bypass security or platform restrictions; interfere with the service; reverse engineer protected components; or use generated material to make unlawful discriminatory, clinical, credit, housing or employment decisions.

6. AI outputs and professional judgment

SoulScan may use probabilistic systems to prepare recommendations, relationship interpretations, communication options and psychometric-style insights. Outputs may be incomplete, inaccurate or unsuitable for a particular purpose. They are not medical, psychological, legal, financial, employment or other regulated professional advice. You remain responsible for reviewing outputs and deciding whether and how to use them.

7. Approvals and external actions

Unless a separate written authorization expressly states otherwise, SoulScan may analyze, recommend, prepare and navigate but does not independently accept contracts, grant rights, move money, purchase advertising, publish content, change permissions, send consequential external communications or perform irreversible actions. Where approval is required, it must be provided by an authorized person and may be scoped, time-limited and recorded for audit purposes.

8. SMS messaging terms

If you opt in to SMS from SoulScan by Travel Growth AI, you authorize the selected categories of messages to be sent to the telephone number you provided. Transactional and promotional consent are handled separately. Message frequency varies and message and data rates may apply. Consent to promotional SMS is not a condition of purchase. Reply STOP to unsubscribe or HELP for assistance. Carriers are not liable for delayed or undelivered messages. You are responsible for providing a number you control and notifying us if it changes.

9. Customer data and permissions

You retain rights in information and materials you submit. You grant Travel Growth AI the limited rights needed to host, process, analyze, secure and present that information to provide SoulScan. You represent that you have the permissions and lawful basis needed to provide the data and direct its processing. We may use aggregated or de-identified information to operate and improve the service where permitted.

10. Third-party services

SoulScan may connect with services such as customer-management, messaging, calendar, email, social, analytics, payment, hosting and AI providers. Your use of third-party services is governed by their terms. We are not responsible for third-party availability, policies, platform decisions or changes, and we do not guarantee that every integration will remain available.

11. Fees and subscriptions

Fees, billing periods, taxes, renewal, cancellation and refund terms are set out at purchase or in an applicable order or statement of work. Except where the applicable agreement or law provides otherwise, fees for a completed billing period or delivered service are non-refundable. We may suspend paid features when undisputed amounts remain overdue after notice.

12. Intellectual property

Travel Growth AI and its licensors retain rights in SoulScan software, interfaces, methods, trademarks, documentation and service-generated system components. These Terms provide a limited, non-exclusive, non-transferable right to use the service during the applicable term. They do not transfer ownership of the platform or permit resale except under a separate written agreement.

13. Availability, warranties and liability

SoulScan is provided on an “as available” basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee specific response, meeting, revenue, ranking, publication or campaign outcomes. To the extent permitted by law, Travel Growth AI is not liable for indirect, incidental, special, consequential or punitive damages, lost profits or lost data. Any aggregate liability will not exceed the amounts paid for the affected service during the three months before the event giving rise to the claim, unless applicable law requires otherwise.

14. Suspension and termination

You may stop using SoulScan at any time, subject to any subscription or statement-of-work commitments. We may restrict or suspend access when reasonably necessary to address security, unlawful use, non-payment, material breach or risk to users or the service. Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers and liability limits—will survive.

15. Governing law and changes

These Terms are governed by the laws of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Quebec will have jurisdiction unless mandatory law requires another forum. We may update these Terms by posting a revised version with a new effective date. Material changes may receive additional notice. Continued use after the effective date constitutes acceptance where permitted by law.
